National Assembly passes Law on Personal Data Protection

VOV.VN - The National Assembly (NA) on June 26 morning adopted the Law on Personal Data Protection, with 433 out of 435 participating deputies voting in favor, equivalent to 90.59% of the total number of NA deputies.

The law will come into force on January 1, 2026. Under the law, small and start-up enterprises may choose whether or not to comply with requirements such as conducting personal data protection impact assessments and appointing designated departments or personnel for personal data protection, for a period of five years from the effective date. These requirements are waived entirely for household businesses and micro-enterprises.

Article 8 of the law stipulates that violations of personal data protection regulations, depending on their nature, severity, and consequences, may be subject to administrative sanctions or criminal prosecution.

In cases where damage is caused, compensation must be made in accordance with legal provisions. Specifically, the act of buying or selling personal data may be subject to fines of up to ten times the illegal proceeds. Violations related to cross-border transfer of personal data may incur fines of up to 5% of the violator’s revenue in the previous fiscal year. Other violations may be fined up to VND3 billion, while individuals will be subject to half the fine applicable to organizations.

Following the vote, lawmakers discussed the draft Law on a State of Emergency, during which the Minister of National Defence provided clarifications on several issues raised by deputies.

After the vote-counting committee reported the results, the National Assembly deliberated and adopted a resolution approving the list of the vice chairpersons and members of the National Election Council.

The NA then convened a closed session to hear the presentation and verification report on the proposed allocation of funds to settle debts under the Government’s responsibility at the Shipbuilding Industry Corporation (SBIC).

In the afternoon, the National Assembly is set to adopt several important legal documents, including a resolution on the exemption of agricultural land use tax; the Law on Vietnam’s Participation in United Nations Peacekeeping Forces; a resolution on tuition exemption and financial support for preschool children, general education students, and learners in the national education system; and a resolution on universal preschool education for children aged three to five.

The day concluded with a discussion on the draft Law on the Transfer of Persons Serving Prison Sentences, during which the Minister of Public Security provided further clarification on issues raised by NA deputies.
