US initiates dual probe into disposable aluminum container from Vietnam

VOV.VN - The United States’ Department of Commerce (DOC) has initiated an investigation into the circumvention of anti-dumping and countervailing duties on disposable aluminum containers, pans, trays, and lids imported from Vietnam and Thailand, the Trade Remedies Authority of Vietnam (TRAV) has said.

The investigation stems from a petition filed by the Aluminum Foil Container Manufacturers Association (AFCMA), which alleges that Vietnam and Thailand have been importing aluminum foil from China, the primary input material for these products, then processing and finishing them before exporting to the US in order to evade duties currently imposed on similar products originating from China.

The investigated products fall under the following HS codes: 7615.10.7125, 7612.90.1090, 7615.10.3015, 7615.10.3025, 7615.10.7130, 7615.10.7155, 7615.10.7180, 7615.10.9100, and 8309.90.0000.

As of now, the DOC has not yet designated any mandatory respondents in the case. However, the agency is expected to select respondents based on statistical data provided by the US’ Customs and Border Protection (CBP).

According to American law, the DOC is expected to issue a preliminary determination within 150 days from the initiation date (tentatively by December 4, 2025), and a final determination within 300 days (tentatively by May 4, 2026). While the investigation timeline may be extended if needed, it generally must be completed within 365 days, with the final deadline set for July 7, 2026.

To protect their legitimate rights and interests, the TRAV recommended that local manufacturers and exporters of the products under investigation proactively review their export activities to the US market.

Furthermore, it is essential to thoroughly study the relevant US regulations and anti-circumvention investigation procedures, strictly and fully comply with all requests from the US investigating agencies, and maintain close co-ordination with the TRAV throughout the entire handling of the case.
